We went to Go Nissan to lease a V8 Pathfinder, I was driving a Murano and loved Nissan, wanted to get something bigger. I already knew what I wanted. We went there, talked to Go Nissan sales guy, the manager all the appropriate parties and advised what we wanted. Ryan Fish showed us the V8 Pathfinder, I sat in it, said I wanted it. We went inside, my husband did the sales price dance and they finally agreed on the terms of the lease. We signed a Lease Order and they told us it would take some time to get all the paperwork together, go have dinner, which we did. This was at 8pm at night, approximately. Came back after 9pm to pick up the car etc.
The Lease Order we signed was for a V8 Pathfinder and 48,750 miles a YEAR. I received a V6 Pathfinder. Yes, this was just discovered in June, approximately 18 months after I had been driving the car. I am not a car person, I didn't know it wasn't a V8 until it was serviced and they told me I needed new tires for my V6 Pathfinder. I was like huh? I have a V8. That is when I pulled out all my lease paperwork and there is says on my Lease Order....V8. The VIN is apparently for a V6. NO WHERE in any of my lease paperwork is the description of the vehicle broken out except in the Lease Order.
Everywhere else, the vehicle is referenced by the VIN...which to MY knowledge (based on the Lease Order we signed) that VIN was for a V8. So how were we, the consumers, to know that? The duty is on the dealership to ensure that the paperwork is correct. They breached that duty. That isn't even mentioning the mileage issue. 48,750 miles a YEAR? So by the time we turn the car in, miles will be 144,000 miles?? We are doing them a favor and saying we will terminate the lease now (without penalty) and the vehicle is still worth something to them. Otherwise, attorneys tell me I also have a case for turning my car in with 144,000 miles without penalty. Bottom line is, the dealership was careless with their paperwork and we are the ones suffering. Not only that but the monthly payment I am making, to our knowledge, was for a V8, not a V6.
Go Nissan (thru their attorney) offered $19,000 toward the payout left on the car, which is $23,467. Obviously, that is not acceptable we want to terminate the lease WITHOUT any penalty to us. We feel we have already suffered enough!
I have been in contact with AutoNation and they too are not doing anything for me.
