On 9/9/09 I test drove a vehicle similar to the one that I applied for financing on because I was told by Mark that the vehicle in questions was being transferred over from another dealer! When the vehicle apparently arrived at your location I was called in the same afternoon to come in and fill out documents for financing and to pick up the vehicle. I signed the documents before even entering the car and after entering the car Mark was fully informed of the mileage being over the stated amount listed on the odometer disclosure and the scratches on the side panel doors from the inside!! I am quiet sure this vehicle has backed up records that will indicate the damages and mileage on it and if I have to some how seek this information to confirm this matter then I most definitely intend to. Also, questioned on 9/9/2009 was the fact that the vehicle was listed for $13,995 and the documents stated $14,995. in response to this I was told by Mark that there is a bank fee which was included in the selling price that all banks require which now I am completely informed was a lie!!
John was informed of the mileage issue in his office the day he called me back on 9/22/2009 to sign finance documents that were dated 9/16/2009. On these documents was now printed the correct selling price listed of $13,995 but another odometer disclosure was never printed up for me to sign so I completely forgot as a single 24 hour mother would and just accepted the car as is with the documents as is. On 10/7/09 I sent an email to Mark requesting status of the registration and in response on 10/7/09 he stated they will be to me soon.
On 10/12/09 I sent an additional emailing advising Mark that I have contacted the Motor Vehicle to check on the process of registration and they stated they have no registration on file for the VIN number in question. I forward the same email to Mark on 10/13/09, 10/15/09 and 10/26/09 and all emails were being read because I received the notifications. Finally Mark responded on 10/26/09 stating that you were having a problem getting the bank to approve my loan and that I was fully aware of the issue which had to do with me being in Check Systems so the credit union would not process my paper work. He also stated to call him ASAP on his cell and listed the number. I have a saved voice message from Mark on this day also, stating for me to call and not send any more emails which simply clarifies that the dealer wants nothing in writing for proof of documentation of what's been going on.
I responded to Mark on 10/28/09 advising him that if there was an issue getting me a loan then I was going to return the vehicle and would like my full refund of $700 deposit made on this car. Mark responded on 10/28/09 stating unfortunately it was a problem with the bank issuing me the loan. On 10/30/09 I called Mark on his cell and at the office to advise him I was returning the vehicle that day and he said to bring it in.
I received many denial letters from banks but they offered counter offers on the car loan. I decided to call one of the banks which I will not state which one to get more information regarding the denial and counter offer and I was informed that the dealer was requesting a loan amount in which the vehicle I was trying to finance was below the value for!! So they recommended me to another Chrysler dealer to apply for financing in which I had no problems being approved for a brand new vehicle and the car was registered and taken the same day with out any problems.
I went and returned the vehicle in which your dealer could not get me a loan for on 10/30/09 around 7pm and John was gone for the day. Scott had another male rep which I did not get his name take the keys and Mark, Scott and the male rep refused to provide me with any documentation stating the vehicle was returned or any information on the refund of my deposit. They stated the cashier was closed and if it were open they would have credited the same card they used to process my deposit. Scott also stated that the cashier would be closed the following day on Saturday so for me to call in on Monday and they will refund my deposit with out me having to be there. Monday morning I called the office and Scott stated John was out of the office to confirm and for me to call back the following day. I called Tuesday morning and John stated that Scott was out of the office and for me to call back the following day.
I didn't call back on Wednesday because I contacted my bank to see if I can do anything about this matter and put in a claim against the transaction. They provided me with helpful information so I contacted John again on Thursday morning before proceeding. john stated that Scott was not in the office again and he was under the impression the matter was resolved but for me to call back on the following day. I contacted the office this morning (FRIDAY) over 3 times and the receptionist continued to state that both John and Scott were busy. I decided to go into your office to discuss in person because every one of you been giving me the run around for my refund. When I get to dealer around 1:30pm a sales rep named angel took me to johns office where I had to wait out side and then angel was told to take me to Scott. as we walked to Scott I was also told to wait aside and then angel was told to take me to the cashier to wait for john for my refund. I waited 10 minutes and the cashier Linda advised me that my documents were not complete and I needed to return to Scott. I went to Scott and he told me that I needed to see John.
at this point I got upset and told him that John sent me to him and they he sent me to the cashier and they sent me back to Scott and now I am angry. Scott now tells me that the refund can take up to days to complete the paper work when I was first informed I can received my deposit same day credited back to my card. I went to John and explained to him that this was not fair to me because they failed to get financing for me on a vehicle they gave me to leave the lot with and had me making payments to progressive for insurance. john said for me to call him back by 5pm and he will see if they will credit my account today.
I called John at 4:30pm and he advised me that I was not going to get a refund of my deposit because of a matter with the mileage and the law or rule being 100 miles a day to be used and that I must have went over the intended mileage. To begin with the dealer was fully aware that the mileage stated on the odometer reading was completely WRONG!! and other then this no one stated to me at any point that I could not exceed a certain amount of miles of the vehicle. when I left with the car from the dealer I was under the impression I was going to be financing it and excited. Now this is a huge problem so I seeked further into the matter and contacted friends at another dealer. I was informed that I am liable to receive my full deposit of $700 because you fail to get me financing and that had nothing to do with an issue with me!!
