I asked my girlfriend to purchase a Blackberry Storm cell phone for me while she was travelling (we live in Barbados in the Caribbean). She made the purchase, along with some accessories, at GSM World Phones Inc. on July 2, at 6.14 p.m. When I got the phone and put in the battery it came on and then turned itself off. It never came back on after that. I asked a friend who was travelling to Florida to take the phone back to GSM World Phones Inc. and explain to them that it never worked and ask that it be replace. He was told that we had to contact Blackberry directly.

I called Blackberry and someone there told me they don't know why I was given this information and that they will not be dealing with it. An opportunity to travel came up in September and I took the phone to GSM World Phones again explaining what happened. After some discussion Alan said he would send the phone to be fixed. He subsequently called my girlfriend's cell phone and left a message saying the phone can't be fixed. He did not suggest a way forward. I've tried calling him at the numbers listed on the receipt but one is not in service and the other goes to a fax tone. I am now wondering if this case qualifies for small claims court.
