On 8/13/09, I went for a consultation at Dental Care of Stamford, located at Summer Street, Stamford CT, 06905-5132. We met with Mimi S. who then turned us over to Dr. Jerry Simon.
Dr. Simon examined my daughter and said she had a "bite problem" and that he could correct the "bite problem" and help her jaw pain, with grinding down of teeth. During the consultation, I asked if my daughter's subluxation of mandibular condyle and joint damage can get worse with the grinding down of teeth. He replied no. He put together a plastic appliance for my daughter to use at home (which I found a little odd, because he did not take any impressions and put together in a matter of minutes).After the consultation with Dr. Jerry Simon, he directed us back to Mimi S.. She informed me of the cost which would be $4,000.00 for grinding down her teeth. Dr. Simon said that Sasha had a bite problem. I found strange because the dentists I took my daughter to never stated this. I asked her how many sessions would it take to correct bite, she said that she did not know exactly how many. She said she would give me a discount if paid in full. I asked if I could take paperwork home and think it over, she said it would be best for Sasha to start work right away to help her pain.
I paid with American Express, a total of $3,833.00 and signed paperwork (one paper), which I have copy of, which does not state that the money was non-refundable or that my daughter was obligated to a certain amount of visits. She then said Sasha could go see the doctor for first treatment and that I could go sit in waiting area, which I did. My daughter went to get her first treatment (grinding of teeth) which did not take more than 15 minutes. Mimi gave me the next few appointments (two days 8/18/09 and 8/25/09) and we left. We went for a second visit on 8/18/09. My daughter had a second treatment which again took no longer than 15 minutes. The third visit was scheduled for 8/25/09.
On 8/25/09, I called Mimi and stated that I had consulted with an oral maxillofacial surgeon (specialist) and that the doctor did not advise my daughter to have her teeth grinded. I also read something which stated that grinding of teeth was not a good idea because it was irreversible and may cause more damage and so I thought with Sasha's joint damage already (mandular condyle subluxation), that it may in fact make it worse. I told her I wished to cancel. At this point I asked Mimi for breakdown for the two-visits and she said she would mail it to me.
After a week, I did not receive any paperwork, so I called Mimi S. again. This time, Mimi S. said that the money was non-refundable. I responded by telling her that the paper which I signed did not state that the money was non-refundable. Mimi S. said my daughter signed paperwork at time of consultation. I informed her that I was not aware that she and Dr. Jerry Simon had my daughter sign paperwork without my presence. I told her my daughter is a student and that she is underage (20) and that they did this without my knowledge or consent. My daughter does not know what she signed and they never gave her, or myself a copy of any paperwork.
My daughter is not responsible for any payment. I am the one who made payment on my American Express Card, and who signed the only paper, which does not state that payment is non-refundable or that we cannot cancel treatment. The paper they had my daughter sign is not valid because the American Express card is under my name and that is the card I paid with. The paper I signed for payment which I do have a copy of does not state that it is non-refundable.
