These people advised us they were realtors for college city bulders. Tammy had contacted Dyan on a contract for deed and we were cohoarsed into building a $273k home. They overstated the price of the home to $316k, inflated my income by using Tammy's also, but did not put her on the mortgage as she was in a bankruptcy. They did not tell her she would not be on the home and did not disclose on the application that they used her bad income. They produced false documents, which we have proof are false. We ended up retaining a lawyer, Bryan Battina, who said we had a good case. Half way through the lawsuit he started saying our evidence was not good enough, yet the defendants used it on their behalf.
I advised my Attorney I am Dyslexic, he and three of the six defendants lied to the Judge and said he had just been told. The three defendants got dismissed from the case and our Attorney dismissed himself, with no reason. We have a trial on January 19th and not one lawyer in Minnesota will take the case this late in the game. We have contacted our A.G. and our Governor, they cannot help us.
The mortgage servicing co., SPS has started foreclosure, after they agreed not to until the suit was finished.
I do not qualify to refinance or modify the loan on my income alone.
The realtors and the builder commited fraud and nobody cares, this is very sad. We wrote to our local news station and heard nothing back. We wrote to the President and every Minnesota agency. Nobody seems to care.
