Doctor Latoya ** went forward and medically treated my child without my consent to treat. Doctor Latoya ** had me arrested through a letter to DFCS to remove me from hospital and take custody of my child. Dr. Latoya ** refused to allow my family to take my child in my behalf. Dr. Latoya ** taunted me and told me to my face she had a copy of emergency room consent and that is all needed to move forward with her choice of medical treatment which was a standard care for my child. My child was hit in the mouth (bleeding all over) by either hospital nurses or hospital security or police prying my child from my arms. My child was traumatized to the point he is scared to death to go to a hospital or see a doctor. He was 10, now he is 12. He screamed and cried as he witnessed me handcuffed and led away. I could not comfort my child or say goodbye to my child. The hospital staff held my son down in the bed and guarded his room door. I have never in all my life ever experienced such a thing. I was banned from the hospital.

Some DFCS agency told my family they would release my son to them, but they lied and took my son to 2 different foster homes and would not let us know my child's whereabouts, health or overall well-being. I had to fight in court for 17 days to get my child back. They put us on a year protective child service with DFCS. Please keep in mind, this took place as I was visiting my sister who lives in Georgia. We are from Ohio and just visiting when my son had an asthma attack. My son was transported to the hospital for medical treatment. I came to the hospital with my child, but never left with my child. I came back home to Ohio and that action closed the case.

But for 2 years now I've been trying to get a Georgia attorney to take on this issue, but they will not. The statute of limitation to take this matter to court is due to expire on October of 2010. The Georgia Board of Attorneys told me there is no representation for my case or my family. Much more took place. DFCS had my family submit to drug tests and local and national police background checks. What we went through is unreal and unconstitutional. The hospital patient policy and patient right's handbook means nothing. The doctor and hospital violated every single patient right in the handbook. All the Georgia board lawyers I spoke with informed me there is nothing I can do from a legal stand point because of Georgia laws. Georgia laws allow for immunity for doctors, hospitals and DFCS behavior, good or bad. I went to the FBI, John Lewis, local and state representatives and federal representatives to no avail. Georgia and their doctors, hospitals, and police and court sectors are above the law.

Dr. Latoya ** was not given parental consent to medically treat my child. I clearly and specifically informed Dr. Latoya ** that her service were no longer either wanted or needed. I further informed Dr. Latoya ** that I seek a different doctor to treat my child and I seek a different hospital to treat my child. Dr. Latoya ** had verbal outbursts and hysterically cried out of control in my child's hospital room at the foot of his bed. My child was scared and confused. I wanted out of the situation and my child wanted out of this unusual doctor experience. Dr. Latoya ** threatened to take my child from me should I make the attempt to transport my child to a different hospital. Dr. Latoya ** wrote a letter to DFCS social workers and called the police. I was removed from the hospital by police. Dr. Latoya ** took my child and continued to medically treat my child. Dr. Latoya ** refused to allow my family to take my child to seek medical treatment with a different doctor at a different hospital.

My child was medically treated at the hospital emergency room and my son was treated by Dr. Latoya ** with my child's managed medication. Dr. Latoya ** wanted to give my child other medication I was unfamiliar with. I informed Dr. Latoya ** that my son's asthma has been managed by our family doctor and myself along with his own line of asthma medication for 10 years. My last words to Dr. Latoya **as I was removed from the hospital was, "Do not touch my child, do not medically treat my child." I wish and desire to seek a different doctor and different hospital for my child's medical needs.

My child's asthma was stable at the time he was admitted for 24-hour observation. My child was receiving Albuterol and Atrovent breathing treatments. His body and asthma symptoms responded successfully to these medications and did not warrant other types of prescription drugs. Dr. Latoya ** went forward with medically treating my child without my oral or written consent. As I was escorted away by the police, Dr. Latoya ** taunted me by showing and stating that she had my consent to treat when I signed the emergency room papers to treat my son and that is all she needed to make it all legal and binding.

My son was removed from my home and my son and I were separated for 17 days. I had to fight with my attorney to get my son back from an organization I knew nothing about named DFCS. DFCS acted on the doctor's finding rather than investigating the situation as a whole I was found to be in the right and did get my child back. But the pain and injustice that extended beyond my son's visit to the hospital was due to the actions of Dr. Latoya **.

Dr. Latoya ** wrote that my son in her medical opinion was asthmaticus, which is defined as status asthmaticus is an acute exacerbation of asthma that does not respond to standard treatments of bronchodilators and steroids. Symptoms include chest tightness, rapidly progressive dyspnea (shortness of breath), dry cough, use of accessory muscles, labored breathing and extreme wheezing. It is a life-threatening episode of airway obstruction considered a medical emergency. Complications include cardiac and/or respiratory arrest. My son did not have status asthmaticus because he was playing, painting, playing video games and had responded successfully to his Albuterol and Atrovent asthma treatments. My son had no steroids and had none of the symptoms of status asthmaticus at the time I was present. At the time I was removed and thereafter, I do not know what medical treatment was administered to my child. I do know that Dr. Latoya ** continued to treat my child after I was no longer present according to my family's report of the situation.

I have been managing my child's asthma along with our family doctor for 10 years. Dr. Latoya ** was aware of this and dismissed those historical and vital facts to do what she felt was best for my child's health, medical treatment and well-being at that moment. Dr. Latoya ** and Children's Scottish Rite Hospital support Dr. Latoya ** medical practice and actions to date. Please keep in mind, my child was under no life threatening condition that would warrant such actions from a doctor. I would have supported the doctor' medical decisions and action 110% should my child's life been in danger at any point during his hospital visit. I will do whatever it takes to medically treat my child to save his life, but this doctor/hospital experience was not that type of case. Closing note, neither the doctor nor the hospital would allow my family to take my son home. My child was taken to a DFCS foster family because of this situation. Our family has not been the same because of this horrific event.

Dr. Latoya ** has no medical treatment history with us. This event was our first and last. There is only one medical record at Scottish Rite Children's Hospital and the record is a one day event and no other visit or further history of patient and doctor.
