My family and I have bought a new mobile home from Oklahoma and had moved to Branson View Estates. At first, everything seemed to be working out just fine. The manager and owner were decent to us. 3 months later, the owner decides to kick us out. He never expressed any issues with us. I tried to contact him and when I did, he was very rude and not wanting to talk. The only reason he gave for us to move out was that our home was financed through 21st Century and he did not like them.
The managers had made some racist comments about my cultural background to my wife, which made us very unhappy. We retained a lawyer to get them to stop, and for the most part it did stop. Winter came and my job ended. I made a payment agreement with the manager Dan, and everything was alright for me to pay in full when my taxes arrived. Once my taxes came in, I went to Dan to see what exactly I needed to pay. He wrote down all that was needed and being late in the evening, I told him If I did not make it back in time, I would leave it in the drop box which he agreed.
About an hour or so later, I saw Dan at the local Walmart and he asked me if I had already gotten the money order. I told him I was going to the bank to get it right now. He told me that he called Alan and he had told him not to accept the money. He said he did not know what was going on and was given no reason to why he was told not to accept the payment. We shook hands and went our separate ways.
A few months later, we served with papers to go to court for non-payment and immediate removal from the park. We tried to contact his lawyer but never could get in touch with his lawyer. We left messages, but was never called back. We went to court, met with his lawyer, and we both decided that a continuance was beneficial to both parties as we did not have a lawyer retained for this appearance. His lawyer agreed to meet with us and during the session, he mentioned that he could not do much earlier in the summer due to IRS problems and was currently in the middle of moving to another office. He knew nothing of them, not accepting the money or even why Alan wanted us out.
The court papers said that they demanded payment, but they have never asked for a dime. They never came to the house. The first manager that did the concrete work for the pillars was supposedly on disability and Alan paid him under the table. He did a poor job on the concrete, our home is not level, and he did not even finish the job. They tried to scare us by saying that the inspector for the state came by and wanted us to finish the house and have our seal put on the trailer. The inspector person never said anything to us. Not sure if they were even contacted.
