I have a house listed with Foxtons at 13 Marjorie dr. I have been trying to contact Foxtons for several days now, and no one returns my calls. I wanted to make a price change but again no one returns my calls. I am hearing talk of Bankrupcy. Foxtons is not honoring their part of the contract and I want to cancel it immediately. It's not right for them to hold all of their customers in limbo, they should have to give anyone in the middle of this mess the option to stay with the contract and ride this out or an unconditional release from the present contract! I want an unconditiional release form so I can cancel the contract.


I can't sell my house, I can't relist with another agent or anything.


I am selling my house and on 11/29/05 I contracted with FOXTONS who's listing agent is James R Walsh. We were scheduled to have photos of the property taken on 12/05/05. After coming home on 12/05/05 I noticed that no sign was present nor was there a lock box in place therefore no pictures could have been taken. I had received no phone call from James to inform me of a reschedule.

I called James the morning of 12/06/05, (since I hadn't heard from him) inquiring about the lock box as well as the photos. He stated that he was sorry; and that it was his fault, he also stated that he would come by later on 12/06/05 after his 3 o'clock appointment to install lock box and that he would reschedule the photographer to take pictures. I called James again to remind him that a for sale sign had not yet been posted on the property and would he take care of it (this message went to his voice mail). Contract signed on 11/29/05 as of 12/06/05 no sign yet posted. Needless to say, James never responded to my phone call.

Since James hadn't responded to my phone call nor showed up with the lock box I then proceeded to call his appointment setter Danielle that evening. I explained to Danielle the situation with the listing agent and that I was upset with James and that nothing was being taken care of and that it is very frustrating not getting any response from him. Danielle said that she would get a hold of James and that she would talk to the sign people and get a sign posted. Shortly after talking to Danielle I received a call from James stating that he is the one I'm to talk to, Danielle only set appointments, he went on and said that he would be out tomorrow (12/07/05 with lock box plus he would contact the sign people.

I told him to come by around 3 PM, which he did and I gave him a key. To date 01/17/2006 I do not know if anyone has even looked at our house because their is no communications from FOXTONS listing agent. I received a phone call from James on 01/03 where he recommended that we lower the price from $390,000 to $380,000 I agreed. He also stated that open house is tenative for Jan. 15, but he is not sure if that will be the date. He further stated that he would send the paper work for the new listing price. As of to date Jan. 17 we heard nothing from James Walsh concerning open house nor have we received paper work concerning new listing price. I question the loyalty of FOXTONS as well as the listing agent to sell this house.

I sent a letter to corporate headquarters on the 10th of Jan. explaining the situation with the listing agent. They received the letter 0n 11, Jan. and to date nothing heard from corporate headquarters. It seem a trend with FOXTONS, if they don't communicate with you after a complate received concerning their listing agent then why expect more from said agent? FOXTONS state in their brochure that they are proactive and hard working, they further state that none of their real-estate agents are self-employed. They continue to false advertise that they provide a stress-free management of the selling process. In our case it has not been stress free at all. FOXTONS does not deliver the service that you are lead to believe. NEVER would I recommend anyone to use FOXTONS in the sale of their house. I desire to be released from this contract due to nonperformance.


I was ready to sell my house but didn't want to pay the 6% commission to a regular real state agency, so I asked Foxton, who only charges 3% commission, to show me what they could do for me. Their presentation was very impresive so I decided to go ahead and sign a contract with them to sell my house.

The first day my house was on the market we got an offer for the total asking price, so I figure that we were underselling our house. I called my agent at Foxton and asked him to increase the asking price. His attitude was really negative and he was almost refusing to do it.

Ever since that day he was annoyed every time I call asking for an update. He didn't follow up with me at all. There were many offers coming in, but he will not informed me of all of them, he wanted to sell the house to the first offer. I knew of many of the offers because many of the interested parties would come by and talked to me directly. I contacted his manager asking if I could deal with the manager directly, but he said he could not take this agent completely out of this deal.

The last time I got a call from this agent was around two months ago and today because we were closing on the house, this agent called asking if he could drop by my house to pick up his $11,000 check.

The people buying my house live across from me and they call Foxton saying they wanted to put an offer. These buyers said to us on the closing day that they never knew the agent they spoke to and that Foxton didn't call them for anything, they also had to be following up on the deal.

I sold my house, it was not Foxton, they did nothing for me. I had to be calling them in order to have my sell going. They don't know what they are doing and many of their agents are very young people that have no experience on real state.

I ended up paying over $11,000 of my money to a company that did nothing for me. I will never, ever, recommend FOXTON to anyone. Next time I have to sell a house, I will either do it myself or pay the 6% for good service.
