I bought a Yorkshire Terrier ($600.00) from Jackson Farms Kennel in Carrizo Springs Texas on 12/31/00. The puppy was sick when I got her. She was throwing up on the 2 1/2 hour ride home. The Jacksons said is was from the medicine for her kennel cough.

Between 12-31-00 and 2-15-01 we made many trips to the vet. Her last trip was on 2-18-01 when she stayed on an IV untill 2-23-01 when the vet had to put her down. I have tried to talk with Jackson farm via e-mail, phone and mail. She will not contact me back. I got a lawyer to write a letter ($200.00) but she would not sign for it.

Later I sent it to her through the mail and I am guessing she received it due to the fact it did not get returned to my address. I signed a contract with her that stated the dog was guarenteed for 90 days. If something was wrong with the dog the would be replaced with the same sex and breed. If they could not honor that request they would refund your money. Needless to say they did neither.

I did everthing that the contract stated. Giving notice within 24 hours of the dogs death, written notice from the vet stating what happened to the dog etc.

The best recourse is Small Claims Court.
