On August 3, 1998 I signed a contract for wedding pictures to be taken by Ms Heather F. on August 15, 1998 at Super 8 Motel in Greenville Tx. at 5 pm. We were quoted $450 for full coverage of wedding and reception, and 15 8x10's, 15 5x7's enlargements for $480 additional, 4x5 originals would be included for the full amount of $930.

A deposit of $300 was made on August 3, 1998. The pictures were taken on August 15 1998 and two weeks later I went and picked the poses I wanted of my wedding party. We never got a call telling us the pictures were ready for several months. We called periodically leaving messages and never recieving a return call. Then when we did get a call it was January by a woman named Jamie stating that Heather was in the hospital with Lupus and when she recovered she would take care of our pictures.

We waited and waited then we recieve a call I guess in May stating that we needed to make another payment before the pictures could be sent to the lab, being that Heather was working from home. So on June 11, 1999 we sent a payment for $200 and then the balance on June 30, 1999.

Now mind you the contract that we signed stated portraits would be delivered no later than 4-6 weeks after our order was made. I then moved to Arizona were I am now and this just made it more difficult to get anything done.

Heather refused to return any calls and her assistants claim to know nothing. Letters were sent to her without any response. I highlighted in the letters sent what her contract stated: "In the event of non-performance or non-delivery caused by the photographer, Captured Images Photography agrees to refund payment on all photos not delivered."

But Heather has ignored her own contract. During all of this my wife lost her dad who could not make it to the wedding because of terminal cancer and to make matters worst my nephew who was in the wedding was killed in an automobile accident on Feb. 10 2000. My wedding pictures are the only pictures we have of him and now have become more sentimental to us.

We know that Heather has our pictures because we had to look at them to pick the ones we wanted and I can't believe that someone would take advantage of a special occassion like a wedding. We even had some of our church family try to contact her who had moved to Dallas and the refused to talk to anyone other than my wife and I but they never return our calls or letters.

I have finally filed a claim on Feb. 18 2000 because we had to go to Texas for my nephew's funeral. We even went to Heather's house and they peeked out the window and refused to open the door. I do not know what else to do about this matter.

This has been very hard and now it is becoming expensive because of the claim filed and the fact that we have to travel to Texas to go to court and the phone calls back and forth to the court and to call Heather to leave messages as well as sending letters hoping for a response.
