I paid Susie Flemming to photograph my wedding on April 28, 2001. The full amount of 4800.00 was paid on January 03,2001. She came, photographed my wedding, got my preview album to me.
After you get your preview album 2600.00 of the 4800.00 cost is for 50 ten-inch prints in a Marquise album (basically blow ups of the negatives.) I turned this in to her on August of 2001. She said that it would be ready by Christmas-2001. Christmas came and went and she called and said my album would be not ready until the second week of January due to the holidays. I said fine.
Well the second week of January came and went and still no pictures. After countless voice mails to Susie, she finally called me back in May and said they would be ready the first week of June. She said it had been hard for her and she was relying on Gainesville businesses to keep her afloat. She promised it would be there the first week of June.
June came and she called me and said she got my album back from the company and there was a dent in one of my pages so she had to send it back and that it would be ready in July. Well now it's September and I've left her several messages, none of which she has returned. I just want my wedding album!
Well now a year and a half after I've been married, I still can't have memories from my most special event in my life. The photos are all copyright so I can't pay money to get them enlarged myself. This has been hell to get this back. I can't even describe to you the stress I'm under!
We think most attorneys would say that the photos were a "work for hire" and that Jamie can assert ownership regardless of the lensperson's copyright claim. Jamie should get the photos enlarged and forget about it.
